Filing a Complaint

Any member of the University community may file (and is responsible for filing) a complaint against an individual who allegedly violates the rights of another person or a Shepherd University regulation or policy (see Disciplinary Procedures for more detailed information).

 

Shepherd University strongly supports the vigorous prosecution in the State courts of any person who commits a felony within the jurisdiction of the University. Students who are victims of felonies are strongly encouraged to file such complaints with the West Virginia State Police, as well as with the University. Whenever a written complaint is presented to a campus police officer or Student Affairs, the State Police will be notified of any alleged felony if they have not been previously notified. Notification will include the offense alleged and the name of the alleged perpetrator but disclosure of the victim’s identity will be at the election of the student victim, unless disclosure by a University official is legally compelled.

 

I. To report a crime, a violation of campus policy, or complaint, students should contact the following University officials: If you are a victim of or wish to report a crime contact the Campus Police at Call Boxes throughout the campus or at their Office in Sara Cree Hall. (Also see Sexual Assault or Sexual Harassment sections below).

A. If you wish to report a violation of a campus policy or have a complaint against another student, please contact an administrator in the Student Affairs Office or Residence Life Office.

 

II. Sexual Assault

A. Students who are victims of sexual assault or who have questions about such matters are encouraged to contact one of the following campus officials for assistance: The Judicial Coordinator, an administrator in the Student Affairs Office, a member of the Health Center, a University counselor, a member of the Residence Life staff, or any campus Police officer. Students may also contact the rape crisis hotline of the Shenandoah Women’s Center, 263-8292 or 876-6679.

B. Students who are victims of sexual assault have the right to file a complaint with campus officials AND local law enforcement agencies.

1. A student who has filed a sexual assault complaint under University regulations has the right to be accompanied by an advocate or counselor of his or her choosing during a Campus Judicial Board hearing. The advocate may not participate directly in the hearing.

2. If a student files a sexual assault charge against another student under the University judicial system, the complainant has the right to be informed of the outcome of the hearing in the same manner and within the same time frame as the accused.

 

III. Sexual Harassment

Complaints may be formally or informally lodged with the University Affirmative Action Officer, an Administrator in the Student Affairs Office, or the Judicial Coordinator.
