Domestic Violence Protection Order (DVPO)

This is a court order that is designed to stop violent and harassing behavior and to protect you and your family from the abuser. They offer civil legal protection from domestic violence to both male and female victims, as well as minors. A Domestic Violence Protection Order (DVPO) can only be filed against certain persons with whom the petitioner has a special relationship which includes persons with (a) current or past partner relationships (married, dating, living together, parents of a child, roommates, etc.); (b) close family relationships (parents, grandparents, siblings, aunts, uncles, etc.); or (c) a combination of family and partner relationships.

A DVPO is obtained by filing a petition through the Magistrate Court in Charles Town, WV. A hearing for an Emergency Protective Order (EPO) is then held in Magistrate Court. DVPO final hearing is held in Family Court. The order, if granted, can be good for 90, 180 or 365 days
